Omen is not a betting product

Omen is a public record of judgment. You answer questions about what will happen, your answer is kept with the time you gave it, and reality settles it. There is no wagering, no stake, no pot, no buy-in, and no prize. You cannot deposit, withdraw, win, or lose money on Omen, and nothing on Omen may be exchanged for money or anything of monetary value.

A Record, a place in the Standings, and any count, streak, or edge shown alongside them are a description of how you have called things. They are not property, not currency, not a security, and carry no cash value.

Nothing here is advice

Omen is for information and entertainment. Nothing on Omen — a question, a settlement, a Record, a Standing, or anything another caller says — is investment, financial, legal, tax, medical, or professional advice, and none of it is a recommendation to do anything. We are not a licensed advisor or broker. Decisions you make after reading Omen are yours.

Who can use Omen

You must be at least 13 years old. Omen is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, contact hello@projectcodex.io and we will remove it.

You may not use Omen if we have previously removed you, or where the law where you live prohibits it. You are responsible for everything that happens under your account, including calls made on a device you hand to someone else.

Calls are permanent

When you make a call, we keep the question, your YES or NO side, and the server time you gave it. That entry can’t be changed and can’t be taken back — not by you, and not by us at your request. This is the point of Omen rather than a limitation of it: a record you can quietly edit after the fact is not a record.

Once you claim a handle, your handle and the Record attached to it are public by default, and other people may see, link to, screenshot, and share them. Before you call on a question, we hide how other people called it. After you call, that information is yours to see.

Deleting your account does not delete your calls. Our Privacy Policy explains what we do instead, which is to sever the tie between the record and you as far as we can without destroying the record itself.

Closing and settling

Every question has a time it closes. After it closes, no further calls are accepted. When reality answers, the question settles and every call on it gets a result.

We settle questions from the sources named on the question, and we may correct a settlement if the source corrects itself or if we got it wrong. If a question cannot be settled fairly — the event didn’t happen, the source never answered, or the question turned out to be ambiguous — we may withdraw it, in which case no answer is recorded and it doesn’t count for or against anyone. Our determination is final except where it is plainly mistaken, and you can always write to us to say we got one wrong.

Questions, sources, closing times, and settlement rules can change before a question closes, and we may add or remove questions at any time.

Your account and handle

A handle is licensed to you for as long as you use Omen; you don’t own it. We may refuse, reclaim, or rename a handle that impersonates someone, is reserved, infringes a trademark, or is offensive. Keep your sign-in method secure and tell us promptly if you think someone else has your account.

What you may not do

Omen has no tolerance for abusive behavior or objectionable content. When something is reported, we review it and remove content or remove the person responsible — usually within 24 hours. You agree not to:

• Post anything harassing, hateful, threatening, sexually explicit, or otherwise objectionable — including in a handle, display name, photo, or a name you put on a board.
• Impersonate anyone, or misrepresent your association with anyone.
• Manipulate the record: multiple accounts to inflate a Record, coordinated calling, exploiting a settlement or timing bug rather than reporting it.
• Scrape, crawl, bulk-download, resell, or automate access to Omen without our written permission.
• Attack or reverse-engineer Omen, or try to reach data, accounts, or systems you have no right to.
• Use Omen to break a law, or to infringe anyone’s rights.

What you provide

You keep ownership of what you provide — your handle, display name, photo, the name you put on a board, and anything you send us. You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it for the purpose of operating and promoting Omen, including in share cards and link previews that you generate.

If you send us feedback or an idea, we may use it without owing you anything for it.

What we own

Omen, the Omen name and marks, the interface, the question set, and the settlement work are ours and are protected by intellectual property law. These terms give you permission to use Omen personally and non-commercially; they give you nothing else.

The App Store and third parties

When you get Omen from the App Store, Apple’s Licensed Application End User License Agreement also applies, and where it conflicts with these terms for the app itself, it governs. Apple is not a party to these terms, has no obligation to support Omen, and is a third-party beneficiary entitled to enforce them against you.

Omen relies on services we don’t control, and depends on third-party sources for the facts that settle questions. We are not responsible for those services or sources, and an outage or an error at one of them can delay or affect a settlement.

Ending it

You can stop using Omen at any time and can ask us to close your account. We may suspend or end your access if you break these terms, if we need to protect Omen or the people using it, or if we stop operating Omen. Sections that should outlast the agreement do: permanence of calls, what we own, disclaimers, liability, and disputes.

Disclaimers

Omen is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Omen will be uninterrupted or error-free, that a question will close or settle on time, or that a settlement will be accurate or free of correction.

Limitation of liability

To the fullest extent the law allows, neither Omen nor its officers, employees, or suppliers is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunity — including anything arising from a settlement, a correction, a withdrawn question, or a decision you made after reading Omen. Our total liability for any claim relating to Omen will not exceed the greater of one hundred U.S. dollars or the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold harmless Project Codex, Inc. from claims, damages, and reasonable legal fees arising out of your use of Omen, what you provide, or your breach of these terms or of anyone’s rights.

Disputes and governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Before filing anything, contact us at hello@projectcodex.io — nearly everything is faster to fix that way. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Delaware, and you and we each consent to their jurisdiction. You and we each agree to bring claims only individually, and not as a plaintiff or class member in a class or representative action.

The rest

These terms, together with the Privacy Policy, are the entire agreement between you and us about Omen. If a provision is unenforceable, the rest stays in force. Our not enforcing something is not a waiver of it. You may not assign these terms; we may assign them in a merger, acquisition, or sale of assets.

Changes

We may update these terms as Omen changes. We will post the revised terms here, update the date above, and give additional notice when a change materially affects your rights. Continuing to use Omen after a change means you accept it.
